What happens if I haven’t appointed a guardian?

If you have children under the age of 18, making a Will gives you the opportunity to appoint a guardian to care for them if you die. Without appropriate arrangements in place, decisions about their care may ultimately need to be made by the courts and may not reflect the wishes you would have made yourself.

What will happen to my assets and estate if there is no Will?

If you die without a valid Will, your estate will be distributed according to the rules of intestacy. This means your assets may not necessarily pass to the people you would have chosen.

Administering an estate without a Will can also be more complicated and may cause disagreements between family members, particularly where someone believes they were promised a particular possession or heirloom.

Lasting Power of Attorney – Did you know?

If you lose the ability to make certain decisions for yourself, your family does not automatically have the legal authority to make those decisions on your behalf.

A Lasting Power of Attorney (LPA) allows you to appoint people you trust to make decisions for you if you are no longer able to make those decisions yourself.

Putting an LPA in place can therefore be just as important as making a Will.

Around one million people in the UK are currently living with dementia, and this figure is projected to rise to 1.4 million by 2040.

Loss of mental capacity can occur for many reasons and is not limited to dementia or older age. Without an appropriate Lasting Power of Attorney in place, managing someone’s finances, property, health or welfare can become considerably more complicated.

Where no appropriate LPA exists, it may be necessary for family members to apply to the Court of Protection for authority to make certain decisions. This can involve additional time, expense and administration at what may already be a difficult time.

Making a Lasting Power of Attorney while you have capacity allows you to decide in advance who you trust to act on your behalf.
